GENERAL

1. Introduction

The Standard Promotional Terms and Conditions outlined in this document shall apply to all the promotional offers PlayStar (the "Company", "We", "Us") makes available through its Website(s) and Software (to "You", the "Patron", "Player") in conjunction with any other conditions as specified separately on a Promotion’s individual webpage ("Specific Promotional Terms"), and in combination with Our Terms and Conditions of Use, the PlayStar Club Terms and Conditions, and Our Privacy Policy, all of which shall collectively be known as the "Rules", forming a legal agreement between You and Us which can be amended solely with Our authorization. Through Your participation in any Promotion, You demonstrate that You accept the Rules and agree to be responsible for Your compliance to such Rules.
Before participating in any Promotion, You are encouraged to review these Standard Promotional Terms and Conditions and any relevant Specific Promotional Terms.
Should there be any inconsistency or conflict between the terms outlined in these Standard Promotional Terms and Conditions, a promotion’s Specific Promotional Terms, and the Terms and Conditions of Use, for the benefit of resolving such conflict or inconsistency, the Specific Promotional Terms will prevail, followed by these Standard Promotional Terms and Conditions.
The manner in which You use the Company’s Website(s), Services and Software shall be in accordance with these Rules.

2. Promotions: Promotional periods, eligibility and participation

The Company will periodically host Promotions which may consist of the following, or a combination thereof, including bonus offers, prize draws, contests, competitions, league table promotions, tournaments, or similar.
The promoter of such Promotions is PlayStar, the Company in which You have entered an Agreement under the Terms and Conditions of Use.
You will be informed of each Promotion relevant to You through communications via email, computer pop-up, app notification, an individual web-based landing page, as well as via other means of communication (the aforementioned shall be known as "Promotion Communication").
The Company’s Promotions are open only to Patrons who have registered with PlayStar, with the exception of being stated otherwise in the Promotion communication.
Promotions shall be limited to one offer per person, family, household, address, or organization, with the exception of being stated otherwise in the Promotion communication. If a Promotion communication states the participation of multiple participants is permitted, We reserve the right, in Our sole discretion, to restrict the number of participants as We render appropriate. Furthermore, it is the decision of the Company to limit participation in certain Promotions solely to Patrons who fulfil specific criteria.
With the exception of being stated otherwise in the Promotion communication, only persons specified as the addressed recipient, or those who are deemed, in the Company’s sole discretion, to meet the Promotion’s criteria for eligibility, will be afforded access to participate in the Promotion, and such eligibility cannot be transferred. Participation by anyone other than the intended recipient will null and void both that person’s and the Patron’s participation in the Promotion.
Unless otherwise stated, You may only participate in, and benefit from, one Promotion at a time. You may only be entered into a Promotion once, unless otherwise indicated in the relevant Specific Promotional Terms.
The duration of each Promotion ("Promotion Period") will be specified in each Promotion’s Specific Promotional Terms, after which time a Promotion will automatically close once the end of the Promotion Period has been reached, with no further participation in that Promotion being permitted. Should a Promotion not specify a Promotion Period, the Promotion will end upon its discontinuation on the Company’s Website(s) and Software.
The following stipulations must be met in order to be eligible to participate in any of the Company’s Promotions. You must:
- be twenty one (21) years of age or older;
- have registered and opened a real money account in accordance with Our Terms and Conditions of Use;
- have the legal right to use Our services through Your compliance with Our Terms and Conditions of Use;
- meet all other conditions of eligibility as outlined in these Standard Promotional Terms, in conjunction with the relevant Specific Promotional Terms;
- not be an Unauthorized Person (as defined in Section 3, below)
Your Participation in any Promotion is optional. To take part in a Promotion, it is imperative that You adhere to the requirements described in the relevant Promotion Communication, on the Promotion’s web landing page, and the relevant Specific Promotional Terms. In the event the Promotion Communication implies that any wagering is not necessary to participate in the Promotion, Your participation in the Promotion will be secured simply by Your acceptance of the Promotional Terms, indicated by Your clicking of the “Participate”, or similar, button.
Where a Promotion is solely targeting new Patrons, or is explicitly described as a "new Patron", "new player" or "sign up" offer, or similar, participation in the Promotion will be limited to those who have not previously opened an account and/or made a deposit on Our Website(s) and/or Software (a "Qualifying Patron").
The identity of participants in Our promotions will be established from some or all of the following information made available to the Company upon registration of an account: name, address, email address, credit/charge/debit card number, IP address, as well as from other forms of identification that may be requested. The Company may, in its sole discretion, request further information from You in order to ascertain Your eligibility for a Promotion.

3. Excluded and disqualified patrons

Patrons located outside of the State of New Jersey will not be eligible for any of the Company’s Promotions. As specified in the Terms and Conditions of Use, the Company may refuse any payments from or to Patrons, or use of the Company’s Products and Services, should a Patron be found to log into, or play from, their PlayStar gaming account under a different IP to one within the State of New Jersey (collectively, “Unauthorized Persons”). In such an event, the Company reserves the right, in its sole discretion, to terminate Your account.
The following persons are prohibited from registering a PlayStar account or engaging in real money game through the Company’s Website(s) and Software: employees, officers, directors, consultants or agents of PlayStar or any of its subsidiaries, parent or associated companies; any of its or their respective vendors or suppliers (including any advertising, printing and publicity agencies); any employees, officers, directors, consultants or agents of any entity associated with any Promotion; or relatives of any of the aforementioned persons, such as, but not limited to, a spouse, partner, child, sibling or any person living at the same address as one of the aforementioned persons.

4. Wagering requirements and withdrawal restrictions

Before a bonus may be played with and/or withdrawn, certain conditions and/or withdrawal requirements must be satisfied, in addition to the general eligibility criteria specified in these Standard Promotional Terms. Similarly, in order to be eligible for a prize or competition, contest, league or tournament, particular conditions and criteria must be fulfilled. The additional restrictions or requirements that apply to a bonus or promotion will be outlined in the relevant Specific Promotional Terms. 
Confirmed Wagers: A Wager is only considered to have been placed if it is recorded on Our system, at which time, the Wager amount will be deducted from Your PlayStar account balance. Once this happens, the Wager is deemed final and cannot be canceled if We consider it confirmed, with the exception of the Wager being declared void due to a breach of any of the Rules or system malfunction. Please refer to the “No Warranty” section of Our General Terms and Conditions of Use for more information regarding malfunctions and voiding pays.
Minimum Wager: Unless otherwise specified, the minimum Wager in any of the Company’s games is USD 0.01 (one cent).
Deduction of Wagers / Unresolved Wagers: Once you have placed Your Wager, its cost will be deducted from Your PlayStar account balance, regardless of when the result is concluded. Any winnings attained as a result of the Wager will be subsequently credited to Your gaming account upon completion and settlement of that round of play. We are not able to refund any Wagers for future rounds that have not yet been completed and settled.
Our right to Cancel or Terminate Games: Without notice and in the Company’s sole discretion, We may cancel, change, remove or terminate any Game at any time. Should the cancelation, change, removal or termination of a Game render it impossible to complete and settle Your Wager, the round shall be deemed null and void and the Wager will be credited back to Your PlayStar account.
Our right to Postpone Games: At our sole discretion, We may need to postpone a Game at any time. When this happens, gameplay will cease, all Wagers will be frozen and the Game will recommence at a new time of the Company’s choosing.
When a Promotion stipulates that a particular number of games or hands be played or wagers be placed, such activity performed on a tournament table will not be counted unless the Promotion is a tournament or is otherwise specified in the relevant Specific Promotional Terms.
When a Promotion stipulates that a particular number of Points be accumulated, this refers to the Points the Company will allocate You in accordance with Your participation in a particular amount and/or type of game play during the respective Promotion Period only, unless otherwise specified in the relevant Specific Promotional Terms. Points accumulated through depositing, or those that have been accumulated in any way outside of the relevant Promotion and its stipulations, will not be counted towards a Promotion’s eligibility criteria, unless otherwise indicated in the relevant Specific Promotional Terms. Points may not be reclaimed after being redeemed in connection with a Promotion.
Certain games and types of games will not be considered for the purposes of meeting a promotion’s wagering requirements. You are encouraged to familiarize Yourself with the games that are not included in a Promotion, by referring to the Promotion’s Specific Promotional Terms.
You may choose to cancel a bonus in Your PlayStar account, at any time, should You wish. To do so, visit the My Offers page > Active Bonuses > Cancel or contact Our Customer Support Team. Should You cancel a bonus before fulfilling its wagering requirements, the bonus will be forfeited, as will any winnings accumulated from it.
Bonuses, and any winnings accumulated from them, with the exception of those that have been converted to cash, may be forfeited should You withdraw all or some of Your account balance, or as a result of the Company determining that You have in any way abused a Promotion, including, but not limited to, by taking advantage of a flaw, failure, feature or other characteristic of the Website(s) or Software.
Should You attempt to withdraw funds that include a bonus without having fulfilled the bonus wagering requirements, withdrawal restrictions or general terms and conditions, the entire sum of the Bonus and any winnings arising from it will be forfeited and deducted from Your PlayStar account.

5. Game contributions

Unless local promotional terms state otherwise, the following promotional terms apply to all bonuses. The percentage of funds staked that contribute toward meeting a wagering requirement differs according to game or game type, as follows:
- Slots, Slingo and Instant Tap games: 100%
- Roulette: 60%
- Live Casino, Blackjack, Video Poker, Baccarat, Dragon Tiger games and all other games not listed above: 0%

6. Bonuses

Real money bonuses will be credited into the PlayStar accounts of Patrons eligible to receive the bonus (Qualifying Patrons) within seven (7) days from the time the Patron satisfies all conditions applicable to a Promotion, subject to the terms outlined herein and unless otherwise indicated in the relevant Specific Promotional Terms.
If more than one bonus, or an excess payment, is credited in error to a Qualifying Patron, the Company reserves the right, without prejudice to any other rights under the Rules, to deduct the bonus or payment from the Patron's PlayStar account as and when it deems appropriate.
Bonus abuse: Bonuses are offered to Patrons for the purposes of enhancing their enjoyment of the games and to provide an opportunity to Patrons to experience and assess the various games and features available, as well as a gift of free play to reward Our valued Patrons. The Company maintains a zero tolerance policy with regards to Patrons engaging in bonus abuse, fraud, suspicious activity and/or taking unfair advantage of the Company, Website(s), Software or other members, and as such We reserve the right to withhold and/or remove any bonuses, associated winnings and/or deposits from any Patrons that We suspect, in our sole discretion, to be associated with any such behavior. Such behavior may include, but not be limited to, the following:
- using multiple accounts in order to receive a bonus more than once;
- utilizing a bonus in order to reach a large account balance through the placing of high risk wager(s) which is subsequently followed by a number of low risk wagers to complete bonus wagering requirements;
- depleting a bonus or waiting for a bonus to expire in an attempt to collect a winning payout from an unfinished game;
- zero risk bets, low margin betting, equal betting, or hedge betting in order to exploit bonuses;
- collusion between Patrons, through the intentional registration of multiple accounts in order to avoid compliance with these Standard Promotional Terms and Conditions and/or the Specific Promotional Terms and Conditions;
- collusion between Patrons, deliberate acts of cheating, and/or other behavior deemed by the Company, in its sole discretion, to be unreasonable and/or unfair; and/or
- exploiting or manipulating an error, fault or loophole in Our Website(s) or Software.
As part of our zero-tolerance policy with regards to bonus abuse as specified above, bonus funds and the deposits required in order to attain them, will incur the application of a maximum bet in respect to slot games or any other valid game, as indicated in the Specific Promotional Terms and Conditions, or as otherwise previously communicated to Qualifying Patrons. A Patron’s entire bonus will be forfeited, including any bonus funds that may remain, and any winnings accumulated from the bonus, should We deem the Patron to be abusing Our maximum bet limits.
The Total Balance of a Patron’s PlayStar account consists of the following:
- Cash Locked to Bonus Funds: Deposited money that has triggered a bonus with wagering requirements plus winnings from cash locked to bonus funds. These funds are considered to be bonus funds for the duration they are locked.
- Cash Balance: Real money funds that can be withdrawn without restrictions.
- Bonus Balance: Any bonuses received plus winnings from bonuses.
Patrons are required to meet the wagering requirements specified in a promotion’s Specific Promotional Terms in order to be eligible to withdraw a bonus or any part thereof. Funds are deducted in a certain order to meet bonus wagering requirements. While a bonus is active and wagering requirements are pending, funds for wagering are firstly deducted from a Patron’s Cash Locked to Bonus Funds balance, and only once there are no funds in the Cash Locked to Bonus Funds balance will funds in the Bonus Balance be played. Finally, when there is no balance remaining in either the Cash Locked to Bonus Funds balance or the Bonus Balance, funds in a Patron’s Cash Balance will be played.
Only one bonus may be wagered at a time. The wagering of bonuses is achieved in the order the bonuses were credited in, with wagering counting toward the first bonus received, and then to the second and so on.
While a bonus is still active, any winnings from funds wagered will first credit a Patron’s Cash Locked to Bonus Funds balance up to the amount the Cash Locked to Bonus Funds balance contained prior to the wager. Any winnings that exceed this amount will credit a Patron’s Bonus Balance as bonus winnings.
Should a wager be placed that uses a combination of funds from the Patron’s three balances (Cash Locked to Bonus Funds, Cash Balance and Bonus Balance), winnings obtained will be credited as such:
- Cash Balance – winnings will be credited in proportion to the percentage of the wagering contribution, i.e. if 20% of the wager came from the Cash Balance, 20% of the winnings accrued would be credited to the Cash Balance.
- Cash Locked to Bonus Funds – winnings are credited up to the amount of the original Cash Locked to Bonus Funds balance before the wager took place, without ever increasing beyond its original balance.
- Bonus Balance – any further winnings will be credited to the Bonus Balance and can only be withdrawn once the bonus’s wagering requirements are met.
Bonuses may be canceled by a Patron before meeting the wagering requirements. When a bonus is canceled, the bonus awarded and associated winnings accrued from the bonus balance, as well as associated bonus winnings accrued from the Cash Locked into Bonus Funds balance, will be forfeited. The remaining balance in your Cash Locked into Bonus balance will become unlocked and may be withdrawn.
To cancel/forfeit a bonus, a Patron can do so from the My Offers page in their account.
The wagering requirements of a bonus must be met before the date specified in the promotion’s Specific Promotional Terms, or the bonus funds and any winnings obtained from its wagering will be forfeited.
Patrons may be required to report for tax purposes any winnings accumulated from the wagering of bonuses or from cash wagers used to meet bonus wagering requirements.

7. Prizes and prize draws

It is solely the Patron’s responsibility for ensuring their eligibility in a Promotion and entitlement to receive a Prize. We reserve the right not to award a Prize, and to pursue the return of any Prize already awarded, should a Winner be deemed not to be entitled to receive such Prize, in accordance with relevant law, or in the event We have cause to exclude the Winner from the Promotion in accordance with Our Terms and Conditions of Use.
Should You take part in a Promotional contest, league or tournament and choose not to progress to the next round after qualifying to do so, Your place will be forfeited and You will be ineligible to win the Promotion’s final Prize or a Prize for any subsequent rounds.
Unless specified otherwise, the drawing and/or determining of a Promotion’s Winner(s), and the subsequent payment of their bonus Prize to their PlayStar account, will take place by the date and/or time indicated in the relevant Specific Promotional Terms.
Any prize awarded to a Qualifying Patron ("Winner") via a Promotion based on a competition, draw, contest, league or tournament ("Prize") will be provided as advertised and deemed appropriate by the Company, with the Winner possessing no right to a cash payment, other than in circumstances whereby We, in Our sole discretion, choose to offer a cash alternative. Should the aforementioned take place, the cash alternative offered may have a value lower than that of the original Prize. The Company may at any time substitute a Prize with one or more alternative prizes of an equal value, other than cash, particularly when it is impractical or at an excessive cost to deliver a Prize to the Winner.
The entitlement to receive a Prize may not be transferred to others.
In the event You are eligible to be awarded a tangible, non-cash Prize, the Prize may be delivered to You, and for which You will be required to sign upon receipt of its delivery. We reserve the right to, in Our sole discretion, make a Prize available only for collection, should We deem its delivery impractical or at an unreasonable cost. When a tangible, non-cash Prize is to be awarded, all reasonable attempts will be made to contact the Winner using contact details on their PlayStar account. However, if within 30 days of the Prize being won, We have not been successful in contacting the Winner, We reserve the right to cancel the awarding of the Prize with no liability to the Winner, or to draw another Winner in place of the original Winner.
In the case of a Winner being eligible for a Prize that includes an event, activity, vacation, or service, the Winner is required to comply with the instructions, itinerary and conditions made by any relevant third party in charge of the organization of the Prize. The Winner will be required to comply with any date or time restrictions, which may not be able to be re-scheduled, as well as any other restrictions on eligibility enforced by the organizer. The arrangement and agreement pertaining to the Prize of an event, activity, vacation or service will be a matter solely and directly between the Prize Winner and the relevant third party organizer, with which We shall have no involvement nor liability in regards to its execution. No insurance will be provided by PlayStar, such as cancellation insurance or public liability, with relation to any Prize consisting of an event, activity, holiday or service.
It is the Winner’s sole responsibility to pay any applicable tax in respect of any Prize received. Where there are costs associated with a Prize or its use, such as costs involved in the compliance of local laws, this shall also be payable by the Winner. Such costs could include, but are not restricted to, the cost of vehicle registration, motor insurance and/or driving license in the case of the Prize being a motor vehicle; or, if the Prize includes foreign travel, the costs payable by the Winner may consist of any passport, visa and travel insurance requirements; or, if the Prize is specific to a particular location, such as an event, activity or vacation, unless otherwise specified, the Winner will be required to incur the cost of travel to and from the relevant location.
In the event We refer to a third party entity by name or trade mark for the purposes of detailing a Prize, such names or trademarks are proprietary to the third party, and no license, affiliation, endorsement or sponsorship is or should be assumed from the use of such, nor from the use of a photograph of a Prize. The use of any photograph to promote a Prize is purely for illustrative purposes and may not accurately represent the Prize itself, including differences in, but not limited to, its make, model, specification, color, finish, packaging and/or other characteristics. 
The offering of a Prize does not infer any endorsement, sponsorship or affiliation on Our part on or with a particular manufacturer, supplier, provider or organizer.
It is the Winner’s sole responsibility to make appropriate use of the Prize. The Company will not establish or accept any conditions, warranties, representations, or other terms between Us and any person, except as specifically stated in these Standard Promotional Terms, with regards, but not limited, to any terms with relation to the reliability, suitability, standard, or fitness for purpose of any Prize, or any other implied terms, all of which shall, as permitted by law, be fully excluded.
In the event a Promotion consists of a prize draw, all entries (as detailed below in the "Prize Draw Process") will be collated from Qualifying Patrons and submitted into a draw from which Winners will be drawn at random. We guarantee not to exhibit any preference or bias towards, but not limited to, gender, age, geographic location, longevity as a Patron of the Company.
A Promotion’s Prize Draw Process is as follows:
- Each Patron meeting the criteria of a Promotion ("Qualifying Patron") will be submitted into a prize draw, which consists of a Microsoft Excel spreadsheet containing a randomly sorted list of Qualifying Patrons who are each allocated a random unique ticket number ("Unique ID"), beginning with number 1 up to the total number of entries for the Prize Draw in question;
- The Microsoft Excel random number generator function will then randomly collect the respective number of winning Unique IDs as corresponds to the number of Winners the Promotion is to award a Prize to;
- Our Head of Promotions or similarly responsible and senior person will act as the "Prize Draw Adjudicator", overseeing the drawing of the Prizes, and whose decision on the validity of the outcome is final;
- The Prize Draw Process will be conducted at one of our HQ offices by the Prize Draw Adjudicator and will be witnessed by a legal representative.

8. Free Spins

From time to time, Free Spins, that is, a specified number of cost-free spins on certain slot games, may be offered to particular Qualifying Patrons as a bonus, reward or incentive. The Company will award a particular number of Free Spins in its sole discretion, which will be subject to the terms outlined below.
Free Spins may be given to Qualifying Patrons as a result of any of the following scenarios:
- after a new Qualifying Patron registers an account in accordance with an offer that comprises of Free Spins;
- after a Qualifying Patron takes part in a Promotion that awards Free Spins upon meeting a certain criteria;
- as part of a Promotional or Marketing campaign; or
- as We deem appropriate at Our absolute discretion.
The specific terms relating to Free Spins are detailed in the relevant Specific Promotional Terms. In the absence of such, the following will apply:
- Qualifying Patrons may receive Free Spins in two ways: while playing a particular game, or during a specific time frame within which the Qualifying Patron will be required to claim the Free Spins;
- Free Spins have a validity period after being granted, during which time the Qualifying Patron must use their Free Spins or they will automatically expire;
- If You have any Free Spins remaining at the time of their expiry, We reserve the right to cancel them;
- Free Spins may only be used on specific slot games as specified in the Specific Promotional Terms; and +. Unless stated otherwise in the Specific Promotional Terms and Conditions, winnings from Free Spins will award the Qualifying Patron with unrestricted cash.

9. Rewards

Patrons will have the chance to receive credits that have the potential to award Bonuses and Prizes (“Rewards”), simply by engaging in certain activities, such as playing particular games and/or playing games during a certain period, meeting playing targets, depositing money, participating in particular events and Promotions, or engaging in game activity with other Patrons.
Rewards may also consist of exclusive and unlocked new games or features, bonus offers, special access to tournaments and promotions, cash prizes and/or other tangible or non-tangible gifts. In the case of Rewards including Free Spins or bonuses, these Rewards will be subject to the release and withdrawal restrictions as described in the Wagering Requirements section of this Agreement, unless indicated otherwise.
In addition to the stipulations mentioned in this section, you are encouraged to refer to the PlayStar Club Terms and Conditions for further information with regards to the PlayStar Club loyalty program.

10. Publicity and intellectual property

From time to time, We host or organize events in respect to Promotions. Should you be entitled to attend or participate in such an event, You are required to adhere to the following requirements: You will not utilize any organization’s branding or advertising that We may consider to be Our competitor; and You will not present Yourself or act in such a manner that might, in Our judgment, harm the reputation of Our Company, any of Our affiliates, or any of Our or their respective brands. 11. Our liability

We are not liable in any way in respect to Your participation, or inability to participate, in any Promotion, or Your use, or inability to use, a Prize, to the maximum extent permitted by law. Governing Law and Jurisdiction: With respect to the Company’s Rules and any dispute between You and Us arising out of or in connection with the Rules or any Promotion, You and We agree that the laws of the State of New Jersey will prevail and that any dispute will be handled only by the courts of New Jersey.
